Zofran Lawsuit Filed in California
A new Zofran lawsuit was filed in the California Superior Court in Alameda. This lawsuit was filed on behalf of a child who was allegedly born with a serious heart defect after his mother was prescribed Zofran for treatment of morning sickness during her first trimester of pregnancy. According to the March 6, 2015 filing in the Alameda Superior Court, the baby’s mother was prescribed Zofran, off-label, for nausea and vomiting that she experienced during the first few months of her pregnancy.
The boy was born in 2010 with supraventricular tachycardia. The lawsuit alleges that Zofran prenatal exposure was the direct and proximate cause of the child’s injuries.
Several other Zofran lawsuits have been filed over the last couple of months also alleging that the drug manufacturer, GlaxoSmithKline, improperly marketed the drug for off-label use in pregnant mothers. This off-label use resulted in the drug being prescribed to expectant mothers, who would later learn of the potential risks associated with Zofran exposure.
Children who have suffered various birth defects, including heart abnormalities and defects, mouth deformities, and brain defects or deformities may be able to pursue a claim against the manufacturer of Zofran. Although Zofran has been listed as a Category B drug, there have not been sufficient studies to show that use in pregnant women would not cause harm to the mothers or to their unborn children.
